ফৌজদারী কার্যবিধি, ১৮৯৮ এর ধারা ১৯৩ অনুসারে দায়রা আদালতে সরাসরি মামলা করা যায়না বা মামলার Cognizance গ্রহণ করতে পারেনা। তবে ম্যাজিস্ট্রেট ১৯০ ধারায় মামলা আমলে নিয়ে নথিসহ দায়রা আদালতে পাঠালে দায়রা জজ বিচারের জন্যে ১৯৩ ধারার ক্ষমতাবলে অপরাধ আমলে নেন বা Cognizance গ্রহণ করেন।
